Human Factors Horizons website offers products and services provided by Kosmidou DIDASKEIN SRL, hereinafter (“HFH,” “us,” “we,” or “our”). These Terms of Use (“Terms”) govern your use of our website and other products and services (“Services”). Please read these Terms carefully, and contact us if you have any questions. By using our Services, you agree to be bound by these Terms, including the policies referenced in these Terms.

You may use our Services only if you can form a binding contract with HFH, and only in compliance with these Terms and all applicable laws. When you create your HFH account, and subsequently when you use certain features, you must provide us with accurate and complete information, and you agree to update your information to keep it accurate and complete.

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, and revocable license to use our Services. You may download content from our Services only for your personal, non-commercial use, unless you obtain our written permission to otherwise use the content. You also agree that you will create, access, and/or use only one user account, unless expressly permitted by HFH, and you will not share access to your account or access information for your account with any third party. Using our Services does not give you ownership of or any intellectual property rights in our Services or the content you access.

Paid Services from HFH

HFH offers paid Services for a fee (e.g. online training courses and mentoring sessions). Unless otherwise stated, all fees are quoted in Euros (€). You are responsible for paying all fees charged by or for HFH and applicable taxes in a timely manner with a payment mechanism associated with the applicable paid Services.

To ensure that you have reached the Desired Learning Objectives (DLOs) for each course an online examination developed and evaluated by HFH SMEs. There is no limitation on the maximum number of attempts allowed for an Examination. Once you pass an Examination you will be awarded a Certificate of Course Completion and/ or Certificate of Course Series Completion.

HFH can provide Training Courses on demand on your Location, upon request. Requests should be sent to: info@hfhorizons.com.

Online Training Courses are delivered in English. Selected Training Courses can be delivered in other languages. For detailed conditions please contact info@hfhorizons.com.

The following conditions are in force in case of virtual mentoring session or course:

  • HFH is not liable for any failure to access or use the educational material due to technical problems attributed to internet connectivity.
  • HFH is making the material available only for the recipient’s use for the agreed duration of the service.
  • HFH explicitly reserves all other intellectual property rights in relation to the structure, operation and content of the service. HFH reserves the right to enforce its intellectual property rights in case of breach; e. but not limited to, in case of unauthorised copying, filming, recording and circulation.
  • It is the responsibility of the service recipient to ensure that the recipient’s equipment meets the minimum technical specifications required for the operation of this service.

If any prerequisites apply to this Training Course, the recipient will make sure that he/she qualifies to take the Training Course.

Feedback

We welcome your suggestions, ideas, comments, and other feedback regarding the Services (“Feedback”). By submitting any Feedback, you grant us the right to use the Feedback without any restriction or any compensation to you. By accepting your Feedback, HFH does not waive any rights to use similar or related Feedback previously known to HFH, developed by our employees, contractors, or obtained from other sources.

Privacy Policy & GDPR Compliance

Therefore, the visitor must carefully read the contents of this page before using the services of our website. This privacy policy may change from time to time according the relevant legislation. We will not explicitly notify our customers or our site’s users about these changes. Personal information collected by this site and why we collect it

This site collects and uses personal information for the following reasons:

Website traffic monitoring

Like most sites, this site uses Google Analytics (GA) to track user activity. We use this data to determine the number of our site visitors to better understand how they find and use our web pages. Although GA records data such as your geographic location, your device, your web browser, and your operating system, none of this information identify you to us. GA also records your computer’s IP address, which could be used to identify you, but Google does not provide access to it. We believe that Google is a third data processor that is compliant with the requirements of European legislation.

Contact forms and e-mail links

If you choose to contact us using a contact form or an email link, none of the data you provide will be stored to our site or transferred or processed by any third party data processor as defined below in the section «Our third-party data processors». Instead, these data will be sent to us via an SMTP protocol (Simple Mail Transfer Protocol). Our SMTP servers are protected by a TLS security protocol (also known as SSL), meaning that email content is encrypted before being sent over the Internet. The content of the email is decrypted by our local computers and devices.

Newsletters

If you choose to subscribe in our newsletter, the email address you submit will be forwarded to MailChimp which manages our e-mail marketing services. MailChimp is a third-party data processor (see «Our third-party data processors» below). Your e-mail address will not be stored in any of our databases. Your e-mail address will remain in the MailChimp database for as long as we continue to use our e-mail marketing services or until you explicitly request to be removed from the mailing list. You can do, using the delete link contained in all the email newsletters we send you.
As long as your e-mail address remains in the MailChimp database, you will receive periodic (approximately once a month) e-mail newsletters from us.

HFH disclaims any responsibility or liability related to your access or use of, or inability to access or use, such third party content.

Copyright and Trademark

HFH respects the intellectual property rights of our users and other third parties and expects our users to do the same when using the Services.

If you believe in good faith that materials on the HFH platform infringe your copyright you may send us a notice requesting that the material be removed or access to it blocked.

The notice must include the following information:

  • the physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed;
  • identification of the copyrighted work claimed to have been infringed (or, if multiple copyrighted works located on the platform are covered by a single notification, a representative list of such works);

HFH also respects the trademark rights of others. Accounts with any other content that misleads others or violates another’s trademark may be updated, suspended, disabled, or terminated by HFH in its sole discretion. If you are concerned that someone may be using your trademark without proper permission on our Services, please email us at info@hfhorizons.com, and we will review your submission. If we deem appropriate, we may remove the offending content, warn the individual who posted the content, and/or temporarily or permanently suspend or disable the individual’s account.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE HFH PARTIES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM: (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES; (B) ANY CONDUCT OR CONTENT OF ANY PARTY OTHER THAN THE APPLICABLE HFH PARTY, INCLUDING WITHOUT LIMITATION, ANY DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT; OR (C) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR CONTENT OR INFORMATION.

YOU ACKNOWLEDGE AND AGREE THAT THE DISCLAIMERS AND THE LIMITATIONS OF LIABILITY SET FORTH IN THIS TERMS OF USE REFLECT A REASONABLE AND FAIR ALLOCATION OF RISK BETWEEN YOU AND THE HFH PARTIES, AND THAT THESE LIMITATIONS ARE AN ESSENTIAL BASIS TO HFH’S ABILITY TO MAKE THE SERVICES AVAILABLE TO YOU ON AN ECONOMICALLY FEASIBLE BASIS.

YOU AGREE THAT ANY CAUSE OF ACTION RELATED TO THE SERVICES MUST COMMENCE WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES. OTHERWISE, SUCH CAUSE OF ACTION IS PERMANENTLY BARRED.

Indemnification

You agree to indemnify, defend, and hold harmless the HFH Parties from any and all claims, liabilities, expenses, and damages, including reasonable attorneys’ fees and costs, made by any third party related to: (a) your use or attempted use of the Services in violation of these Terms; (b) your violation of any law or rights of any third party; or (c) User Content, including without limitation any claim of infringement or misappropriation of intellectual property or other proprietary rights.

Governing Law and Venue

The Services are managed by Kosmidou DIDASKEIN SRL, which is located in Bucharest, Romania. You agree that any dispute related to these Terms will be governed by the laws of Romania.

Revisions to the Terms

We reserve the right to revise the Terms at our sole discretion at any time. Any revisions to the Terms will be effective immediately upon posting by us. For any material changes to the Terms, we will take reasonable steps to notify you of such changes, via a banner on the website, email notification, another method, or combination of methods. In all cases, your continued use of the Services after publication of such changes, with or without notification, constitutes binding acceptance of the revised Terms.

Refunds

Except as described in this Refund Policy or as explicitly stated as part of the sign-up process for a Service, HFH has no obligation to provide refunds or vouchers for any other Services.
